Right to manage
Providing leaseholders with the right to take control of the management of their building
Advantages of Right to Manage
When the Government introduced the Commonhold and Leasehold Reform Act 2002, it provided leaseholders with the right to take control of the management of their building. This process is known as the Right to Manage (RTM) and is available to all owners of private leasehold flats, subject to a few reasonable criteria.
Most leaseholders do not own their freehold and have little control over how their building is managed. Unjustified service charge increases are a widespread problem. Understandably, many leaseholders are keen to:
Have a direct say in how their building is managed
Reduce their service charges
Make the managing agent accountable directly to them
RTM Benefits
Replace underperforming managers
Maintain high standards through improved oversight
Gain full control over decisions, including:
- Placement of Buildings Insurance
- Engagement of contractors
- Determination of service charge level

How Long Does the Process Take?
From the incorporation date of the RTM Company, the process typically takes around five months, assuming at least half of the flat owners sign up within two weeks.
If the required sign-ups are obtained before incorporation, the total timeline is approximately 19 weeks from incorporation.
What to Expect
While challenges may arise, most landlords accept the rights of leaseholders under this legislation. We are seeing strong demand for RTM Company formation.
